4. Products and services provided
Through this website, Inwatt offers air conditioning equipment installation services, specifically air conditioning, under the conditions described in clause 6, as well as products and equipment in the areas of air conditioning, heating, renewable energies, and electrical installations, as and when they become available in the online store.
The images of products and services shown on the website are purely illustrative, aiming to reproduce the actual product or service as faithfully as possible. There may be slight differences between the image and the product supplied, particularly due to changes introduced by the manufacturer. If in doubt, please contact us before making a purchase.
5. Order fulfilment
The articles and services presented on the website are available throughout the national territory, unless otherwise indicated on the product or service page.
To place an order, you must select the products or services and add them to your shopping basket; confirm the items in the basket and enter a discount code, if applicable; select the shipping method or, in the case of services, confirm the installation location details; fill in the mandatory billing details (an email address and a telephone number are required); indicate, if applicable, a delivery address different from the billing address; fill in the order notes with any additional information relevant to processing or delivery/installation; select the payment method; and, finally, read and accept the present Terms and Conditions and click on “Finalise order”.
Upon finalising an order, the user enters into a contract of sale and/or provision of services with Inwatt. At the end, a confirmation screen is displayed with the order details, and the customer subsequently receives an email confirming receipt of the order.
6. Installation Services
6.1. Scope of installation service
The price of each installation service shown on the website corresponds to a standard installation, the scope, conditions, dimensions and elements of which are detailed on the respective product or service page and in the accompanying documentation. These specific conditions are an integral part of the contract and shall prevail over these Terms and Conditions in all respects specific to them.
Installation services are available throughout the UK, under the conditions indicated on each service page.
6.2. Additional work
Standard installation does not include any work not specified in the specific service documentation, namely civil engineering work, alterations to existing infrastructure, special lifting equipment or other work whose necessity is identified on-site.
When the need for additional work arises, it will be subject to a preliminary quote, presented to the client for express acceptance before execution. In case of refusal which makes the installation unfeasible, the service order will be cancelled and the amount paid refunded to the client.
6.3. Scheduling and Client Obligations
The service execution date will be scheduled with the customer after payment confirmation. The customer undertakes to ensure access to the premises on the scheduled date and time, with the presence of an adult during the intervention; to ensure that the premises meet adequate safety and working conditions; to obtain the necessary authorisations beforehand, particularly from the homeowners' association, when the installation involves facades, common areas or external alterations to the building; and to inform Inwatt of any relevant site constraints.
In the event of the service being impossible to perform due to a reason attributable to the client, the service will be rescheduled under the terms communicated to the client.
6.4. Service performance before the end of the withdrawal period
If the customer wishes for the installation service to be carried out before the expiry of the 14-day cooling-off period (clause 14), they must give their prior and express consent for the commencement of the service provision, acknowledging that they will lose their right to withdraw once the service has been fully performed. This consent is obtained during the ordering or scheduling process.
7. Non-processing of order
Inwatt reserves the right to cancel any order, even if confirmed, in the following situations: product unavailable; service unavailable in the geographical area or unfeasible under the local conditions; incorrect billing information; payment for the order not received; manifest error in the price of the product or service; delivery failed at the indicated address.
In these cases, the customer will be informed of the reason for the cancellation, by email or telephone, within a maximum of 30 days, and reimbursed for any amounts paid.
8. Product Availability
Inwatt aims to keep its stock levels updated on a daily basis. In the event of an occasional error regarding availability, the customer will be notified by email or telephone and may choose to exchange the product for another available item or to cancel the order.
If you do not wish to exchange and the order relates to a single item, it will be cancelled and the customer will be refunded using the same payment method, within a maximum of 14 days. If the order includes other available items, we will proceed with sending the remaining ones, and the customer will be refunded the value of the unavailable item using the same payment method, within a maximum of 14 days.
9. Prices
The prices shown on the website include VAT at the current legal rate and are exclusive to the website, and may differ from those charged in the physical store.
Prices and specifications are subject to change without prior notice, without prejudice to orders already confirmed. Despite our daily update efforts, pricing errors may occur, and prices are therefore verified during the processing of each order. If the correct price is lower than advertised, we will refund the difference via the same payment method. If the correct price is higher, we will inform the customer as soon as possible, by email or telephone, and they may accept the new price and pay the difference or cancel the order with a full refund.
Installation services are priced at the standard installation rate indicated on the respective page; any additional work will be quoted under clause 6.2. Products with special characteristics, of high weight or volume, or identified as “price on application” will be quoted on a case-by-case basis.
10. Payment methods
The website offers the following payment methods: bank transfer, MB WAY and Multibanco reference.
Payment information is entered in a secure environment provided by the payment service provider. The customer declares they are the legitimate owner of the payment method used.
The invoice will be sent by email, in PDF format. Order processing (dispatch or scheduling of the service) will begin after confirmation of good payment. Orders with uncompleted payments will be cancelled after 48 hours.
11. Shipping and delivery methods
11.1. Store pickup
Customers can opt for free collection at Inwatt's physical store: Quinta da Ramalhosa, Lote 52, Loja 2 R/C, 3510-141 Viseu. You will receive an email when the order is available for collection, with the location and order code.
11.2. Home Delivery
The client is responsible for the truthfulness and accuracy of the shipping details provided. In the event of an error in the address provided by the client that necessitates a resend, the respective costs will be borne by the client.
Barring exceptional circumstances, the order will be dispatched within a maximum of 30 days from confirmation of payment. Delays may occur due to product customisation, made-to-measure items or items subject to a quotation, unforeseen circumstances or constraints in the delivery area. If it is not possible to meet the delivery date, the customer will be informed and may either accept a new date or cancel the order and receive a full refund of the amount paid.
Deliveries are made by courier or by Inwatt's own means, on working days. Estimated delivery times after payment confirmation (except for force majeure): 1 to 5 working days for mainland Portugal; 8 to 10 days for the Madeira Archipelago; 11 to 20 days for the Azores Archipelago (shipments to Corvo, Flores and Graciosa may add 6 to 12 working days).
Irregularities in island connections, unrelated to the carrier, may compromise these deadlines. Products with "price on request" status (special characteristics, high weight or volume) may be limited to delivery within mainland Portugal, with delivery times and costs provided after assessment.
Upon receipt, the customer must check the order in the presence of the delivery person. If any damage, visible defect, or discrepancy from the order is detected, it must be recorded on the delivery document, and you may refuse receipt, informing us immediately.
11.3. Impossibility of delivery
In the event of an unsuccessful delivery attempt, the customer will be informed, via email or mobile phone, of the location of the parcel and the procedure for a redelivery attempt. Once the included attempts have been exhausted, storage and redelivery attempt charges, which will have been previously communicated, may be charged to the customer.
12. Transfer of risk and ownership
The customer acquires ownership of the products upon Inwatt's receipt of full payment for their value, including postage. The risk of the products transfers to the customer at the point of delivery.
13. Order Cancellation
Orders for which payment is not successfully received will be cancelled after 48 hours. The customer may request cancellation of an order before the products are dispatched or the service has begun, except for custom-made or made-to-measure orders that are already in production. To confirm the possibility of cancellation, please contact us via the online form or using the details provided on the website.
14. Right of withdrawal
Under current legislation (Decree-Law no. 24/2014, of 14 February), the consumer client has the right to cancel the contract, without needing to state any reason, within 14 days from: a) in the case of the sale of goods, the day on which the consumer, or a third party indicated by them (with the exception of the carrier), acquires physical possession of the goods; b) in the case of several goods ordered in a single order and delivered separately, the day of physical possession of the last good; c) in the case of goods consisting of several batches or pieces, the day of physical possession of the last batch or piece; d) in the case of service contracts, the day the contract is concluded.
To exercise this right, the customer must inform us of their decision, within the timeframe, through a clear and unambiguous statement, using the online form or the contact details available on the website.
Exempt from the right of withdrawal, as per the law: services that have been fully performed, provided that performance began with the express prior consent of the consumer and they acknowledged the loss of their right of withdrawal after full performance (clause 6.4); goods made to the consumer's specifications or clearly personalised; sealed goods which cannot be returned for reasons of health protection or hygiene once opened after delivery; and goods which, after delivery, become inseparably mixed or incorporated with other goods, particularly equipment that has already been installed.
In the event of cancellation, products must be returned complete, in their original packaging, without signs of use, and accompanied by the invoice. Return costs are borne by the customer; cash-on-delivery returns will not be accepted. Refunds will be processed using the same payment method within a maximum of 14 days from the notification of the cancellation decision. Inwatt may withhold the refund until receipt of the returned goods or proof of their return, whichever occurs first.
The decrease in value of goods resulting from handling beyond what is necessary to ascertain their nature, characteristics, and functioning is the responsibility of the consumer.
15. Warranty and lack of conformity
Under Decree-Law No. 84/2021, of 18 October, goods purchased by consumers benefit from a legal guarantee of conformity for 3 years from the date of delivery, subject to presentation of the invoice.
In the event of a lack of conformity, the consumer is entitled, under the terms of the law, to the repair or replacement of the goods, an appropriate reduction in price, or the termination of the contract. A lack of conformity which becomes apparent within 2 years of delivery is presumed to have existed on that date, unless this is incompatible with the nature of the goods or with the characteristics of the lack of conformity.
When the installation of the goods forms part of the contract and has been carried out by Inwatt or under its responsibility, incorrect installation is considered a failure to comply with the goods themselves. Installation services provided by Inwatt benefit from the applicable legal warranty.
The warranty does not cover anomalies resulting from misuse, incorrect handling or installation by the customer or unauthorised third parties, normal wear and tear, or lack of maintenance recommended by the manufacturer.
To claim the warranty, the customer can go to the physical store or contact us via the online form or the contact details available on the website. Once the lack of conformity is confirmed, the repair or replacement will be carried out within a reasonable period, free of charge to the consumer and without causing significant inconvenience. In the event of a refund, this will be made using the same payment method used for the purchase, within a maximum of 14 days from the confirmation of entitlement.
16. Refund method
Refunds will be issued to the customer, whenever possible, using the same payment method as the original order. If payment was made via Multibanco reference, the refund will be processed by bank transfer, and the customer must provide their IBAN by email. The customer will not incur any fees related to the refund.
17. Promotional campaigns and codes
Whenever a campaign is underway on the website, its specific conditions (description, eligibility, duration, exclusions) will be detailed on the campaign page. Website campaigns and promotional codes are only valid for purchases made on the website, unless otherwise indicated.
18. Responsibility
Inwatt makes every effort to keep the website information up-to-date and correct, but cannot exclude the occasional occurrence of errors, reserving the right to correct the information and to cancel orders affected by manifest error, under the terms of clause 7.
Inwatt is responsible, under the law, for damages caused to the customer that are attributable to it. Nothing in these Terms and Conditions excludes or limits Inwatt's liability in cases where such exclusion or limitation is not permitted by Portuguese law, nor does it affect the rights legally recognised to the consumer.
19. Processing of personal data
Access to and use of the website are subject to our Privacy Policy, available in the website footer, which outlines the terms of personal data processing and data subject rights.
20. Customer Support, Complaints, and Alternative Dispute Resolution
Queries, suggestions, complaints and grievances can be submitted via the online form or the contacts available on the website. They will be dealt with as quickly as possible and, in any case, within a maximum of one month.
The customer can also submit a complaint through the Electronic Complaints Book, available at https://www.livroreclamacoes.pt.
In the event of a consumer dispute, consumers may have recourse to Alternative Dispute Resolution (ADR) entities, as provided for in Law No. 144/2015, of 8 September, namely the CNIACC — National Centre for Information and Arbitration of Consumer Disputes (https://www.cniacc.pt. Further information from the General Directorate for Consumers, at https://www.consumidor.gov.pt.
21. Intellectual property
All copyright, trademarks and other intellectual property rights in the materials and content made available on the website belong to Inwatt or its respective licensors. The customer may only use these materials as expressly authorised, without prejudice to the possibility of copying information relating to their order or contract data.
22. Applicable legislation and jurisdiction
The use of the website and any contracts concluded through it shall be governed by Portuguese law. This provision does not affect the rights recognised to the consumer by applicable mandatory legislation.
